Guidance for Mobile Food Vendors and Food Trucks
Where to set up?
- Cannot park or locate on public parks, streets, rights-of-way, or sidewalks without permission from the Town, unless part of an approved event.
- Can park on private property with the landowner's permission, provided all other laws and ordinances are followed. If the mobile food vendor decides to set up consistently in one location, there are specific requirements that must be met for both the mobile food truck and its commissary to meet the Virginia Department of Health and Sanitary Sewer Requirements. Discuss this requirement with the Virginia Department of Health contact and the Wytheville Pretreatment Coordinator.
- Must consider parking location, traffic flow, pedestrian safety, and solid waste disposal in the site selection.
- Consider the impact on existing businesses. Be courteous, and consider locating in non-competing locations or high traffic locations where brick and mortar food and beverage options are not available.
Before setting up the mobile food truck or mobile food vendor
- Must register with the Virginia Department of Health (VDH) and obtain a VDH permit and inspection. Contact: VDH 276-228-5507
- The unit must be self-contained for water and wastewater, or the unit must provide a water source and specify where fats, oils, and grease will be deposited. Contact the Pre-Treatment Coordinator at 276-223-3460 to satisfy this inspection requirement.
- Must contact the Fire Department for an inspection of the unit at 276-223-3368. (If an out-of-town vendor is from Virginia and has already been inspected by their local Fire Marshal, this inspection will be sufficient if shown to the Wytheville Fire Department. If the vendor is out of state, they must be inspected by the local Fire Department.)
- Must register with the Town of Wytheville Treasurer’s Office to pay meals tax on any food and beverage products sold. Must obtain a Town of Wytheville Business Peddler’s License each year, in accordance with the Town Code. Additional questions: 276-223-3333
